Cartel agreements in industry and their impact on the international business development

Abstract

The article considers the goals for creating the international cartels, cartel agreements and the reasons for restraining their activities on the part of States. It describes the damage that can be caused by cartels to the end products (services) user, as a rule, unaware of the existence of the price collusion between the parties to cartel agreements regarding the production, sale and after-sales service of such products. A brief history of the international cartels creation and functioning and law enforcement practices restricting their activities is presented. At the same time, the authors draw on the experience of the USA and EU member states, where the vast majority of major industrial multinational corporations are registered, which, due to their size, are more inclined to conclude cartel agreements and monopolize the market in comparison with other participants. It shows the forms and particular provisions of the cartel agreements of enterprises in the various industries and activity spheres, possible schemes and ways of suppressing fraudulent actions of participants in cartel agreements, as well as the communication types and exchange of the trade, industrial and financial information of the cartel members, including the use of intermediaries.
Examples of the actual cartel collusion cases and their consequences are given. Conclusions are drawn about situations where cartels are useful for the production and international trade development and, as a result, can be temporarily countenanced.
